An impressive crowd turned out for the August 14, 2008 SCA luncheon meeting. The meeting featured a presentation of $5,000 to Make a Wish Foundation, as well as a thorough and enlightening presentation on the latest case law decisions affecting Construction Defect claim litigation in California by Carlos Poza, of the Law Offices of Glaspy & Glaspy.

Happiest Golf Tournament Parlayed Into Make A Wish Donation -
"Shift" in Construction Defect covered, as well

The Sacramento Claims Association resumed its luncheon meeting schedule in pretty grand fashion at The Lion's Gate Conference Center August 14, 2008. Following a two month hiatus, due to the June Golf Tournament and July CCNC, the group reconvened, welcoming special guest, Executive Director from the Make a Wish Foundation, Melinda Carson, to present her organization with a check in the amount of $5,000 to help give a dying child one grand wish of a lifetime.

Ms. Carson shared the story of another Make a Wish child, Samantha, who experienced an amazing and full recovery following her trip of a lifetime to Disneyland that fulfilled her "final" wish. It was a moving story that effectively illustrated the real value of the work this fine organization is doing.

SCA Board Member, Jon Aronson, spoke in a moving way just before presenting the check to Ms. Carson. JM Environmental, the "Eagle" Sponsor of the golf tournament effetively co-sponsored the donation.

Following the presentation, SCA president, Art Coussoulis welcomed monthly guest speaker, Carlos Poza, of the law offices of Glaspy & Glaspy. Mr. Poza spoke in succinct layman's terms about the latest developments with regard to changes in Construction Defect claim litigation.

"There's a buzz in insurance and litigation circles," Mr. Poza stated. As a result of the Supreme Court decision in Crawford vs. Weathershield, the "type 1 Indemnity" provision in Construction Defect law has shifted. No longer will builders/developers be able to ad-hock "push down claims" to subcontractors, he explained. "This is now in flux," he said. The "new shift in the law will bring new focus on the law," he continued.

Subs will no longer be exposed to broad reaches of Type 1 indemnity. "No longer with the door knob installer be dragged into a lawsuit over trouble with the roof," he said.

Mr. Poza did also qualify the reality. "It will take some time before we see much shift, because of the ten year Construction Defect statute of limitations," he explained. But at least subs can breathe a little easier.
